Terms of service

1. The Service

99quests provides a browser-based platform for organizers to design location-based scavenger hunts and for players to participate in Live Runs. We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability, error-free operation, or compatibility with every device, browser, or network.

2. Accounts and eligibility

Organizer accounts may require approval. You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an organizer account or purchase credits.

We may refuse, suspend, or terminate access if we reasonably believe you have violated these Terms, misused the Service, or pose a risk to other users or the platform.

3. Credits, billing, and payments

Live Runs consume credits according to the pricing published on our pricing page. Prices, credit packs, and volume tiers may change; changes apply to future purchases unless otherwise stated. Taxes may apply where required by law.

Payments are processed by third-party payment providers. By purchasing credits, you authorize us and our payment processor to charge your selected payment method for the amounts due.

4. No refunds

All credit purchases and fees are final and non-refundable, except where a refund is required by applicable law or explicitly granted by us in writing at our sole discretion.

Credits are consumed when used for Live Runs and are not redeemable for cash. Unused credits do not expire unless your account is terminated or we publish a different policy. We are not responsible for credits lost due to account suspension for violation of these Terms, organizer error, player no-shows, event cancellation by you, or technical issues outside our reasonable control.

5. Organizer responsibilities

Organizers are solely responsible for their games, routes, questions, media, branding, player communications, and compliance with applicable laws (including privacy, safety, employment, and event regulations). 99quests is a technology platform; we do not organize, supervise, or insure your events.

• Obtain any permissions needed for locations, content, and player data collection
• Provide clear safety instructions and supervise participants as appropriate
• Do not upload unlawful, infringing, harassing, or dangerous content
• Do not resell or sublicense the Service without our written authorization

6. Player participation

Players join via links provided by organizers. Location features require explicit browser permission. Players participate at their own risk and should follow local laws, traffic rules, and organizer instructions while engaging in outdoor or location-based activities. 99quests is not a party to any agreement between organizers and players.

7. Acceptable use

You agree not to:

• Reverse engineer, scrape, or attempt to gain unauthorized access to the Service
• Interfere with or disrupt Live Runs, servers, or other users
• Use the Service for spam, fraud, or illegal purposes
• Misrepresent your identity or affiliation
• Circumvent credit, access, or security controls

8. Intellectual property

We retain all rights in the Service, software, and branding. You retain rights in content you upload, and grant us a non-exclusive license to host, display, and process that content solely to operate the Service. Feedback you provide may be used without restriction or compensation.

9. Third-party services

The Service may integrate with third parties (e.g. payment processors, maps, hosting, analytics). Your use of those services may be subject to their terms. We are not responsible for third-party products, outages, or data practices.

10. Disclaimer

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• GPS, map, or location data will be accurate or available at all times
• Games, routes, or organizer content will meet your expectations or legal requirements
• Revenue, attendance, or outcome estimates on our marketing pages will reflect your results
• Defects will be corrected within any particular timeframe

Any material downloaded or obtained through the Service is accessed at your own discretion and risk.

11. Limitation of liability

To the maximum extent permitted by applicable law, 99quests and its affiliates, officers, directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business interruption, or replacement costs, arising out of or related to the Service or these Terms, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claims arising out of or relating to the Service or these Terms shall not exceed the amount you actually paid to us for the Service giving rise to the claim during the twelve (12) months immediately before the event giving rise to liability, or, if the claim relates to a specific credit purchase or Live Run, the amount you paid for that specific purchase or event.

Some jurisdictions do not allow certain limitations of liability; in those jurisdictions, our liability is limited to the greatest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless 99quests and its affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, your events, your violation of these Terms, or your violation of any law or third-party rights.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access immediately for breach of these Terms or to protect the Service or other users. Upon termination, your right to use the Service ends. Sections that by nature should survive (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive termination.

14. Changes to these Terms

We may update these Terms from time to time. We will post the revised version on this page and update the “Last updated” date. Material changes may also be communicated by email or in-product notice where appropriate. Continued use after changes become effective constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your country of residence require otherwise. Our principal place of business is Tallinn, Estonia.
